Judge Jackie Glass has denied motions filed by OJ Simpson and Clarence Stewart seeking new trials. She also denied requests to reduce bail. Both defendants will return for sentencing Dec. 5, 2008 at 9 a.m. in Dept. 5.

A motion hearing has been scheduled for Friday (March 7) at 10 a.m. in District Court Department 5 (Courtroom 15A). A television/audio feed has been established and a multbox has been placed in the Clark County parking lot on the corner of Bonneville and Casino Center Avenues. Media interviews must be conducted outside of the Regional Justice Center on the courthouse steps next to the Clark Avenue entrance. No cameras, other than authorized pool cameras, will be allowed to enter the courtroom.
District Court Judge Jackie Glass will hear arguments on 16 motions filed by prosecutors and defense lawyers. The hearing will be broadcast by truTV (CourtTV), which is serving as the television pool representative. None of the defendants are expected to appear in court.

Judge Douglas Herndon denied two motions this afternoon filed by the defense in State v. Mack clearing the way for a sentencing hearing scheduled in Washoe County at 10 a.m. February 7. The two-day sentencing hearing will allow victims, families, and the defendant to present evidence to the judge prior to sentencing.
This afternoon, Defense Attorney William J. Routsis argued that the proceedings should be stayed while he prepares an appeal to the Nevada Supreme Court of Judge Herndon’s ruling to deny Darren Mack a new trial. Judge Herndon denied the motion indicating that a challenge to his ruling can still proceed in front of the higher court without impacting on further proceedings.
In regards to the motion to continue the sentencing of Mack, Routsis argued that his client had not interviewed with the Nevada Division of Parole and Probation and that he wanted his client to have the opportunity to prepare a supplemental report. Routsis indicated he believed that Parole and Probation would recommend the maximum amount of time in prison because Mr. Mack had not interviewed with the Division. Judge Herndon indicated that the defense had been given the opportunity to interview with the Division and had chose not to attend the interview. However, even in light of that decision, Herndon indicated that he did not plan to rely on the Division’s recommendation alone and had set aside two days to allow the defendant time to tell the court directly what he wants to say and provide the judge with information prior to sentencing.
Judge Herndon indicated that in light of the the amount of time the court intends to devote to the sentencing, and in fairness to the victims and their families, he would deny the motion. Sentencing will proceed at 10 a.m. Thursday (Feb. 7) in Reno at the Washoe County Courthouse.

Documents have been filed with the Court Clerk in State v. Simpson, et. al., by defendants Charles Ehrlich, Clarence Stewart and Orenthal James Simpson challenging the charges in the case. In addition, Mr. Ehrlich seeks to be tried separately from his co-defendants. Ehrlich also seeks to prevent a witness from testifying against him. Additionally, the Clark County District Attorney has filed four documents in the case.

Judge Douglas Herndon will preside over a motion filed by Darren Mack to withdraw his guilty plea during a scheduled two-day hearing in Reno at the Washoe County Courthouse January 15 - 16, 2008. Judge Herndon will extend the hearing if required to Thursday (Jan. 17).
A large number of witnesses are expected to be called in this hearing. If necessary, sentencing of Darren Mack will take place February 7-8 in Reno.
CBS 48 Hours will provide pool coverage for television and a mult-box will be provided. The court proceedings will follow rules set forth by the Nevada Supreme Court and the Second Judicial District.

District Court Judge Jackie Glass signed an order this morning granting a motion to detain O.J. Simpson without bail in the Clark County Detention Center pending a hearing Wednesday (Jan. 16) morning at 9 a.m. in District Court Dept. 5 (15A) to revoke his bail.

A motion by the Tennessee Titans football team seeking to be released from a lawsuit filed by Clark County resident Tom Urbanski was granted by District Court Judge Jessie Walsh. Mr. Urbanski argued that the football team should remain liable for injuries caused during a fight at a local gentleman’s club.
Judge Walsh concluded the court has no jurisdiction over the Tennessee Titans and dropped them from the civil suit. “What’s happened to Mr. Urbanski is incredibly unfortunate, and I haven’t lost sight of that fact. This litigation, however, has nothing to do with the Tennessee Titans,” Judge Walsh said.
Titans football player Adam “Pacman” Jones remains a party to the lawsuit.

Judge Joe Bonaventure denied a motion to compel the District Attorney to use the best original version of any audio tapes of defendant statements when presenting audio evidence at a preliminary hearing or before the Clark County Grand Jury. Bonaventure indicated the motion was premature and these were issues that should be handled at the preliminary hearing.
The preliminary hearing for defendants Michael McClinton and Charles Cashmore has been scheduled for 9 a.m. Thursday (Oct. 4) in Justice Court Department 9.

Defendant Charles Stewart’s attorney has filed a motion seeking the Justice Court to compel the District Attorney to use the best original version of any audio tapes of defendant statements when presenting audio evidence at a preliminary hearing or before the Clark County Grand Jury. In his motion, Robert G. Lucherini asks the court to order the District Attorney to prove an audio tape created by witness Thomas Riccio is authentic and an original copy of the audio gathered before, during and after the events that unfolded September 13, 2007 at the Palace Station Hotel.
Lucherini suggests in the motion that the District Attorney will be unable to produce an accurate copy of the tape, suggesting instead that the tape has been altered or edited.
Arguments on the motion have been scheduled for 7:30 a.m. September 28 (Friday) in Justice Court Department 9.
