  • District Court Judge Douglas Herndon approved a temporary restraining order this morning in the case, Fame Operating Co. v. George J. Chanos, that will delay enactment of Nevada’s anti-smoking initiative for at least two weeks in Clark County. In making his ruling, Judge Herndon indicated this was not a judicial challenge to the outcome of the election, but an opportunity to allow the plaintiffs to question the constitutionality of the law and seek judicial help in implementing the law based on the process provided by Nevada’s Constitution.

    The judge’s ruling affects only those plaintiffs and defendants named in the lawsuit, effectively preventing law enforcement agencies in Clark County from enforcing the law against the plaintiffs named in the complaint. The temporary restraining order has no effect on businesses or law enforcement agencies in other Nevada counties. The law statewide goes into effect Dec. 8.

    A Dec. 19 hearing date has been set for arguments regarding the plaintiffs challenge to the anti-smoking law.

  • The contempt hearing for Attorney Joe Caramango has been rescheduled until 11:30 AM September 28, 2006 in District Court Dept. 12.

  • County Recorder Francis Deane has been charged by the Clark County District Attorney with 19 counts alleging misconduct of a public officer, fradulant appropriation of property, theft, offering false instrument for filing of record, and unlawful commissions, personal profit and compensation of public officers.

    The case number is 06F10930X and is assigned to Justice Court, Dept. 7, Judge Karen Bennett-Haron.

    Deane made an initial appearance this afternoon in front of Judge Karen Bennett-Haron. Deane returns to court Friday (June 16) at 8 a.m. in Justice Court Dept. 7 before Judge Bennett-Haron for a status check where Deane will be required to post a $20,000 bail bond or surrender for arrest.

  • A criminal complaint was filed today (March 20) by the Clark County District Attorney charging Joshua Michael Corcran with Reckless Driving and Involuntary Manslaughter in connection with the February 19 traffic accident that caused the deaths of Victor De La Cruz-De Leon, Reymunda Lopez-Vazquez, Jose Manuel Lopez-Sanchez and Jose Roberto Mejia Lang. Another passenger, Cecilia Cruz, was injured in the accident.

    Corcran has been charged with 5 counts of Reckless Driving and 4 counts of Involuntary Manslaughter. An Arrest Warrant was issued this morning (March 20) by Justice of the Peace Joe M. Bonaventure. Corcran is scheduled to make an appearance tomorrow (March 21) at 8 a.m. in Justice Court Dept. 3, Judge Tony L. Abbatangelo.

  • James Scholl, 34, has been accused of the 2004 murder of a cab driver who was set on fire. The victim, Pairoj Chitprasart, died four days later from his injuries. Scholl also faces burglary, robbery and kidnapping charges for a separate incident involving cab driver Kebede Getahun.
