August Medical/Dental Malpractice Status Checks and November Settlements Scheduled

Chief Judge T. Arthur Richie, Jr announced today that Medical/Dental Malpractice Status Checks will be scheduled for August 4 and 5, 2009 at the Complex Litigation Center, 333 South Sixth Street in Las Vegas.

The status checks will take place between 9 a.m. and 1:30 p.m. each day and will include scheduling for the upcoming November 2009 Medical/Dental Malpractice Settlement Conference Marathon.

The November Settlement Marathon will focus on 131 cases out of compliance with the requirements of NRS 41A. The court intends to make a significant and meaningful attempt to resolve these cases during these settlement conferences.

The Nevada Supreme Court has approved the assignment of Senior Judges to conduct the November Settlement Marathon. A similar marathon between May and June 2009 allowed the court to settle 37 pending cases, which released 75 judicial trial days to take other cases to trial.

Cordero v. Endoscopy Center of Southern Nevada

The first class action complaint has been filed by two individuals against the Endoscopy Center of Southern Nevada alleging the defendants treated patients with dirty syringes that were previously exposed to unknown persons.

Question 5: Summary Judgment

District Court Judge Douglas Herndon determined this morning (Jan. 23) that a portion of the Nevada Clean Indoor Air Act is constitutional, upholding the civil side of the statute, while at the same time declaring the criminal portion of the statue failed to meet a constitutional standard. Under the judge’s ruling, civil penalties will remain, with smokers facing a $100 fine for smoking in a tavern, restaurant, theater, school or airport. However, with the criminal penalties removed, no one will go to jail for smoking. In announcing his ruling, Judge Herndon said he chose to side with voters who chose to make indoor areas smoke free by “allowing the measure to go forward with its full operation and purpose, which is to ban smoking.”

A hearing has been scheduled for 11 a.m. Tuesday (Oct. 31) in Department 3, District Court Judge Douglas Herndon for plaintiffs Petition for Writ of Mandamus and Incorporated Application for Order and Emergency Hearing pursuant to NRS 239.011.

Child Abuse Public Information

This morning Judge Douglas W. Herndon ruled (05-A-510196-P) on a motion filed by Clark County’s Department of Family Services seeking Declaratory Relief in regards to what can be disclosed to the public and the media about child abuse fatalities. The County sought court guidance in regards to how much information to release to the public and what types of information should be released in accordance with NRS 432B.290 and the Federal Child Abuse Prevention and Treatment Act (CAPTA).

Judge Herndon ruled that the following information can be disclosed to the public under Nevada Law and in accordance with CAPTA:

The first and last initials of the name of the child;
The child’s date of birth;
The child’s date of death;
Cause of death;
Child Protective Services/Child Welfare agency response to investigations, summary of services provided, referrals for services made and the results of services, other pertinent information regarding services provided for referrals made, and;
Child Protective Services/Child Welfare agency reasons for closing case, if applicable.

Herndon also ruled that provisions for keeping certain records confidential, as outlined for instance in NRS 432B.407(4), prevent the disclosure of certain documents, and as such, these documents remain confidential and cannot be made public.

Medical Malpractice Case Status Checks

Status checks for medical malpractice cases pending in the Eighth Judicial District Court will be held from 10 a.m. to 5 p.m. Tuesday through Thursday (Feb. 7-9) at the Complex Litigation Center, 333 S. Sixth, Las Vegas.

These status checks allow the court to determine which cases are ready for trial. Those announcing ready will be scheduled for trial through 2007.
