• The first class action complaint has been filed by two individuals against the Endoscopy Center of Southern Nevada alleging the defendants treated patients with dirty syringes that were previously exposed to unknown persons.

The lawsuit, filed Thursday (Feb. 28) afternoon, alleges that plaintiff Michael Cordero underwent a colonscopy at the center in November 2007 and believes he may have been exposed to a dirty syringe. The second plaintiff, Richard Taylor also went to the Endoscopy Center for a colonscopy. The lawsuit asserts Taylor may have been exposed to Hepatitis B, Hepatitis C and HIV through the use of a dirty syringe.

The lawsuit seeks to represent all persons who were treated with dirty syringes for the period March 2004 through January 11, 2008. It also seeks to obtain compensation for the cost of testing individuals for Hepatitis C, Hepatitis B and HIV antibodies.

The case is Cordero v. Endoscopy Center of Southern Nevada, 08-A-558091-C. It has been assigned to District Court Department 13, Judge Mark Denton.
